Can I promote Amiga using BoingBall in my cartoon video?

Hi guys

I've just released new graphics on my old song called Chickens (Pilici) here:

I will create another version on English soon, but as usual I would like to put Amiga somewhere on the video. My idea is to put Boing-Ball baloon that will fly over the sky in second minute.

Do you think it would be OK or it will break Amiga copyright? Will I have problems or not? What is your opinion? It will be just small add-on (for my Amiga soul) but I do not want to break any copyright rules and make my video claimed & shut down. It will also not write Amiga nowhere on the screen.

Incorrect A. Inc Still own the rights to the boing ball etc. Hyperion have a license to use it.

i think a chequered ball is too generic to be subject of any claims. outside of this and few other forums none will identify it with anything, let alone "amiga".

I don't recall A Inc sueing the BBC for the use of 'boing balls' in In The Night Garden'!

Thought you'd already used boing balls anyhow.

First: what exactly turns a red checkered ball into a boingball? Is any red checkered ball a boing ball and therefore in design owned by Amiga Incapable? What is "red" anyway and when is it considered red and when no longer? Is any checkered ball in essence a boingball?
I you add one or two "degrees of latitude" and one or two "meridians", can it then still be considered a "boing ball" proper?

Just some thoughts. I'm not a lawyer. Far from, actually.

My gosh, how many "demos" and beach balls, and Mice and whatever have you seen around? I find it hard that A Inc could have a case. If anything they may have specific brand guidelines of the ball, like the exact angle of the checkers, the correct PMS colors, shadows, etc... if you don't follow those then You are probably not in violation.

First, don't be such a chicken.
Second, as a person that has filed a fair share of Trademarks, Amiga Inc. and/or Hyperion Entertainment cannot claim the image of any and all red & white checkered balls. The Trademark filing and therefore its granting would have had very specific details about the number and relative size of the checks, the angle of check field, and when animated the fact that the rotation of the boing ball alters when bouncing off a wall. It would also stipulate uses, i.e. for the marking of the Amiga computer, computing systems, and associated Amiga 1st party software including but not limited to firmware and operating system.

So unless you are using the exact boing ball mark to promote for a commercial benefit (get paid - as SS mentioned) the Amiga computer et al. then you are have nothing to worry about. And if you're using a bunch of generic red & white checkered balls in your video then you certainly having nothing to worry about.

The worst that will happen is that you'll get a take-down notice.

Had a listen to some of your unfinished old modules I had lying around, and Weird.1.med had a really nice beat. A shame you never went futher with that one. Same with Live ACT.1d.med.

Ask Eric Schwartz if he let you use Sabrina Online, and Amy the Squirrel and if he agrees, just put Sabrina and Amy somewhere in the video playing on the beach in bikini, launching each other anonymous boing ball.
