| huh I'd forgotten about the fact that Acer could be holder of the Amiga licences, which is why I find it odd that Cloanto can claim copyright? I dont quite understand how that could of happened, if I recall I do remember there being some court case over the Workbench name which Cloanto won.
Plus what about Amiga Games Inc? can they use the amiga name and roms if cloanto claims ownership. _________________ AmigaNG, YouTube, LeaveReality Studio |

Not even if Cloanto's agreements predate Gateway?

That is matter of contention, especially after the Cloanto story link was posted over at Investor's Hub, home of WRIT/Amiga Games Inc./RetroInfinity.
The "package" put together, given that WRIT intended to supply games, might be lacking crucial ingredients like the ROMS and licenses for emulation.

Amiga Inc. owns the domain name amiga.com as well as all remaining Amiga-related trademarks (partial list, PDF). They do have a license from Cloanto for their activities on the BlackBerry platform, but no license for any other platforms. |

So does that mean that the Commodore case designs belong to Acer? |
NO.
As I reported in my "off the front page" thread on CUSA, and should probably be copies into the Nedfield thread, which does qualify for AW front page:
Asiarim at the time licensed to CUSA the right to produce these cases obviously. CUSA, however produced their own molds. When C=Holdings B.V. wiped Asiarim off the map and cancelled the licenses to Manomio and CUSA they basically reclaimed these rights.
In addition, now the ebay buyer of the C= case molds is selling cases. This is also discussed in the CUSA thread, as well as the "cease & desist" sent to the case makers by C=Holdings B.V.
Prior to this, observant followers of the AW back pages will note that cases planned by Sean Donahue have basically vanished from the news. Think what you may of this...
Apparently, there is more yet to be said about these "rights", but nothing has become public...yet.

In the other "off the front page" thread, this is covered.
Recently Patrick Roberts, who has departed the scene (former president and COO of Amiga Games Inc.) stated that they do NOT need, nor DID they need to negotiate for ROMs with Cloanto.

I think it is time to return these threads back t front page. Reason for their hidden status is no more (CommodoreUSA marketing campaign). |

That would be up to AW staff, who made the decision based on user feedback.
And there are still many people who don't care for the front page giving the impression that the C= and Amiga IPS are a biblical level disaster, even if that IS true.

You may know I was one of the few Amigaworld.net members not affiliated with CommodoreUSA that were against such move. I was never CommodoreUSA hater and Amiga Mini is in my point of view valid part of Amiga history. |

| This is what happens when copyrights is so fragmented so in the end there is no progress to the hardware nothing new, just copyrights changing hands.
And in the end just about anyone could buy a right to produce anyhting with the name "amiga" on it even making a pc and call it "amiga".
So now cloanto owns it so what happens now what plans do they have.... ?

Well, the date on my post (#12 this thread) with the former text that has survived on the Gateway wiki forever is February 20, 2015.
What a coincidence that on February 21, 2015 this text was changed.

I've heard people question the voracity of wiki before, when it stated something they did not want to hear. I wonder if those same people would question it after the recent edits to "history".

To clarify, C=USA and C= Holding were on extremely friendly terms until Barry's death.

I know that Dammy. Barry and I discussed the "new" folks on AW while everyone else continued their hate fest. I didn't mean to indicate there was any animosity between Ebben and Barry.
the discussion in case you want to read it
Obviously Barry knew LONG before this lawsuit was resolved and even before it was even filed....who the real owners were.

Cloanto on CBM/Amiga Copyrights
Cloanto confirms that it has not granted any rights for making use of CBM/Amiga copyrights in recently announced smartphones.
Aug. 16, 2015 / PRZen / LAS VEGAS -- Cloanto Corporation is the holder of the international copyrights for all copyrighted and copyrightable works created by the original Commodore/Amiga companies up to 1993, as recorded at the United States Copyright Office. These include ROM, operating system, boot code, application software, documentation, multimedia and other components as included in licensed packages such as Amiga Forever and C64 Forever.
Recently, some publications and news agencies reported that "Commodore Business Machines Ltd" (United Kingdom) might be selling, planning to sell or collecting money for orders of smartphone devices that claim to include software emulations of the PET, C64 and Amiga computers.
For the avoidance of doubt, Cloanto hereby confirms that it has not granted any rights to said UK company for bundling or otherwise distributing the original, copyrighted ROM and OS software code used by the PET, C64 and Amiga systems and their emulations. |
etc.
